Andrew M. Wallet is a partner in the Los Angeles law firm of Hinojosa & Wallet, specializing in litigation of all facets of trust, probate, estate, conservatorship, and related litigation and administration. With over 30 years of experience in the field, he is a Certified Specialist in Estate Planning, Trust & Probate Law, as certified by the State Bar of California Board of Legal Specialization. He has also received the highest possible rating of “AV Preeminent” from the Martindale-Hubbell Law Directory. In addition, Mr. Wallet repeatedly has been named a “Super Lawyer” in the area of Trust and Estate Litigation by Southern California Super Lawyers magazine.
Mr. Wallet has litigated numerous matters concerning trusts and estates, conservatorships and guardianships. Representative matters he has handled include will and trust contests, trust and estate administration disputes, testamentary capacity, undue influence, asset recovery, fraud, breaches of fiduciary duty by trustees, administrators and conservators, removal and surcharge of fiduciaries, temporary restraining orders, preliminary injunctions, appointments of fiduciaries, elder abuse, accounting issues, real estate related issues and other matters too numerous to list.
Additionally, Mr. Wallet also acts as a professional fiduciary. A substantial part of his practice involves him serving in such capacities as the trustee of complex trusts, the special or general administrator of probate estates, and as a conservator of estates. Most notably, Mr. Wallet is currently co-conservator of the estate of Britney Jean Spears. Mr. Wallet's fiduciary expertise is regularly utilized by the legal community in matters ranging from general trust and estate administration to complex litigation while managing a wide variety of assets. The Probate Court frequently appoints Mr. Wallet in complex trust and estate disputes, or as conservator of the estate, in those matters where substantial assets and complicated financial issues are involved. He has particular expertise in handling real estate issues.
Representative assets handled include administration and management of units of residential real property, commercial real property, businesses such as entertainment, restaurants, manufacturing, investments, entrepreneurial, art work, law practices, etc.
Mr. Wallet is often able to provide substantial savings to the trust or estate by charging only fees for his fiduciary services. Normally, a private professional fiduciary charges for his or her time in addition to hiring separate legal counsel to represent them who also charges attorney fees for their services. Mr. Wallet is often able to eliminate an entire set of fees for the trust or estate. Additionally, with the consent of the interested parties, Mr. Wallet is frequently able to offer further cost savings by acting as the real estate broker and waiving fiduciary fees related to the sale of real property if feasible under the circumstances.
Mr. Wallet is also a licensed California real estate broker with extensive experience in all aspects of real estate transactions, both residential and commercial.
Mr. Wallet has been active for many years as a lecturer and panelist on trusts, estates and conservatorship law.
