Rebekah E. Swan's practice focuses on all aspects of fiduciary, estate, trust and conservatorship litigation, including matters involving undue influence and financial elder abuse. Rebekah has extensive experience in handling complex trust and estate litigation matters, including trust and will contests, disputes between trustees or executors and beneficiaries, disputes concerning fiduciary and conservator appointments, fiduciary accountings and surcharge issues, contested conservatorship matters, and trust and will interpretation issues. In addition, she has extensive experience in handling estate, trust and conservatorship administration matters, as well as appeals. Rebekah has extensive practice experience before the Probate Court, as well as the civil courts and the California Court of Appeals.
Rebekah has successfully defended clients against restraining orders imposed on them by individuals who were ultimately found to have been unduly influencing the client's elderly family member. She has successfully represented co-trustees against a hired caregiver who secretly married the elderly trustor in an attempt to unduly influence him into changing his estate plan and leave his $15 million estate to her. She has represented a beneficiary of an estate in recovering title to real property that was transferred out of the name of the decedent by an individual involved in an elder abuse scam. Rebekah has also been involved in numerous trust disputes that resulted in the successful resolution of years of litigation between feuding siblings and family members.
Rebekah is frequently appointed by the Probate Court to represent individuals in conservatorship proceedings and conservatorship related actions, as a Probate Volunteer Panel (“PVP”) attorney.
Probate Volunteer Panel attorneys consist of attorneys who have been determined by the Probate Court of the Los Angeles Superior Court to have the requisite skill and experience necessary to assist the Court with the resolution of various proceedings before it.
Prior to joining Hinojosa & Wallet LLP in 2003, Rebekah practiced estate planning, conservatorship law, probate and trust administration in West Los Angeles. Rebekah graduated from Whittier College School of Law in 1996 in the top 10% of her class where she was the Teaching Assistant for the Chair of the Legal Writing Department and President of the Tax Law Society. As a law student, Rebekah received the Manuel W. Wiley Award for providing pro bono legal services to clients of Bet Tzedek Legal Services. Rebekah received her B.A. in English, with departmental honors, from the University of California, Santa Barbara in 1992.
Rebekah is married to Carl Swan, the executive producer of Hello and Company, a television commercial production company located in Hollywood, California. They have two sons, Hart and Birk.
