The attorneys of Hinojosa & Wallet, LLP are frequently called upon to share their expertise and knowledge with other estate planning attorneys. Firm partners Lynard C. Hinojosa and Andrew M. Wallet spoke at a Continuing Education of the Bar (CEB), State Bar of California seminar entitled “Estate Litigation” on December 3, 2010.

Mr. Wallet served as the Program Chair/Moderator and Mr. Hinojosa was a speaker at the seminar. The Hon. Reva G. Goetz also spoke at the seminar, which was held in Los Angeles. The program provided the opportunity to learn from expert trusts and estates litigators and Probate Court bench officers about how to handle complex disputes involving trusts, estates, conservatorships, powers of attorney, and much more.

The all day, comprehensive program afforded a unique opportunity to learn from top trusts and estates lawyers and bench officers in a unique format involving "real life" scenarios. The panel provided a valuable "how to" analysis from intake of the case to resolution, including the following:

  • How to analyze complex legal issues and implement strategies
  • How to set up the pleadings
  • When and how to obtain TRO's and other provisional remedies
  • Use of law and motion practice
  • The complex interplay between trusts, estates, conservatorships, etc.
  • Trial strategies, getting evidence admitted, how to lay a foundation, question witnesses and objections
  • How to use trial time efficiently by identifying burdens of proof and shifting burdens
  • Motions before, during and after trial
  • Application of recent case law, statutes and interpretation

The panelists analyzed the best practices for commencing and defending disputes. Attendees also learned about:   

  • Dealing with the client, ethical issues, and economic analysis of the case
  • Fiduciary duties of trustees, personal representatives and conservators
  • Effective timing and use of mediation and strategies
  • Settlement agreements and how to structure the terms
  • Enforcement of settlement agreements
  • Appeals, enforcement of judgments and attorneys fees
